1. On December 21, 2007, ULDAGE Inc., a company engaged in patent license business, issued a call for patents that are essential for the Standards mentioned above. The details are recited below.

2. The Japan Intellectual Property Arbitration Center will conduct evaluation, through it's evaluators, for the patents submitted to determine as to whether they are essential for the Digital Cable Broadcasting Standards in accordance with the "Procedural Rules for Essential Patent Evaluation " as established by the Center and will issue a Written Essential Patent Evaluation.

To obtain a Written Essential Patent Evaluation , the applicant must submit to the Japan Intellectual Property Arbitration Center an application for Essential Patent Evaluation and other documents required in accordance with the
"Procedural Rules for Essential Patent Evaluation" mentioned above and pay the prescribed fees.

Broadcasting Standards for Patent License Purposes

Today, December 21, 2007, ULDAGE Inc., a company engaged in patent license business, issued a call for patents that are essential for the Digital Cable Broadcasting Standards in Japan listed below:

・The Standards developed by the Japan Cable Television Engineering Association (hereinafter referred to as the JCTEA Standards);
・The Operational Guidelines developed by the JCTA Japan Cable Laboratories (hereinafter referred to as the JCL Operational Guidelines); and
・The Standards developed by the Association of Radio Industries and Businesses (hereinafter referred to as the ARIB Standards).

The purpose of ths call is to create a joint patent pool consisting of the patents that are evaluated by an independent and neutral professional institution as being essential for the above-mentioned Standards to grant licenses under fair and reasonable conditions, thereby promoting expansion of the digital cable broadcasting market in Japan.

The details of the patent submission and the patent evaluation procedures are as follows:

1. Patents to be submitted:
Patents that are:

(1) technically essential for the implementation of the JCTEA Standards, the JCL Operational Guidelines and the ARIB Standards as identified below, and
(2) issued in Japan.

Other ARIB Standards Any portions of the ARIB Standards which are referred to in.the JCTEA and JCL Standards mentioned above as being complied with.

Patents related to MPEG-2 Standards, MPEG-4 Standards, H.264/MPEG-4 AVC Standards, IEEE1394 Standards and Server-type Broadcasting are to be excluded.

(Note) Code symbol "JCL" has been changed to "JLabs" as from October, 2009.

(3) For patents comprising the existing ARIB essential patent portfolios for direct broadcasting using radio waves and which have already received the evaluation as being essential exclusively for the ARIB Standards mentioned above, those are subject to confirmatory evaluation and not for an ordinary evaluation. ( See item " Confirmatory Evaluation " below.)

3. Schedule for the Patent Submission and the Patent Evaluation:

December 21, 2007: Call for Patent Submission
February 29, 2008: Closing of the Initial Submission
( The Call for the Initial Submission will be closed on the date mentioned above to decide the participants in the first meeting of the Essential Patent Holders. However, the Patent Submission and the Patent Evaluation will be continued thereafter.)
End of May 2008: The first meeting of the Essential Patent Holders

Upon completion of the evaluation for the patents submitted during the Initial Submission Period, a notice of the first meeting of the Essential Patent Holders will be sent to those who have received the evaluation as an essential patent for their patent or patents.

4. Evaluation Fees:

The fees for evaluation are :

(1) 800,000 yen for a case in which the number of claims submitted for evaluation is 1 or 2; and
(2) 1,000,000 yen for a case in which the number of claims submitted for evaluation is 3 or 4.
(3) In a case where the number of claims submitted for evaluation exceeds 4, an additional amount of 100,000 yen is to be added for each additional claim (according to the Rules of the Japan Intellectual Property Arbitration Center).

The fee for the Confirmatory Evaluation is 50,000 yen per patent.
