Center's Essential Patent Evaluation

1. About "Center's Essential Patent Evaluation"

The Essential Patent Evaluation is to be conducted by the Center through its evaluators to determine whether or not a particular patent is essential for implementation of the functions and effects as prescribed in one or more of the technical standards (hereinafter, the "Subject Technical Standards") which are specified in the agreement between the Center and the Licensing Organization of Essential Patents relating to the Subject Technical Standards (hereinafter, the "Licensing Organization").

The Procedures for Essential Patent Evaluation are provided for in the "Procedural Rules for Essential Patent Evaluation" As for the flow of the procedures, please refer to the "Procedural Flow of Essential Patent Evaluation.".

Please prepare and submit to the Center an application for Essential Patent Evaluation using the form for " Application for Essential Patent Evaluation" set by the Center.

The Licensing Organization will set the fees for essential patent evaluation in a written agreement with the Center in each of the patent pool to be established.

The Japan Intellectual Property Arbitration Center will conduct essential patent evaluation, through it's evaluators, for the patents submitted to determine whether they are essential for the ARIB Standards in accordance with the "Procedural Rules for Essential Patent Evaluation", as established by the Center, and will issue a Written Essential Patent Evaluation.

To obtain a Written Essential Patent Evaluation, the applicant must submit to the Japan Intellectual Property Arbitration Center an Application for Essential Patent Evaluation and other documents required in accordance with the "Procedural Rules for Essential Patent Evaluation" mentioned above and pay the prescribed fees.

The purpose of the call is to create a joint patent pool consisting of the patents that are evaluated by an independent and neutral professional institution as being essential for the ARIB Standards in order to grant an overall license under the fair and reasonable conditions, thereby promoting expansion of the digital broadcasting market in Japan.

4. Evaluation Fees:

The fees for evaluation are :

(1) 800,000 yen for a case in which the number of claims submitted for evaluation is 1 or 2; and

(2) 1,000,000 yen for a case in which the number of claims submitted for evaluation is 3 or 4.

(3) In a case in where the numder of claims submitted for evaluation exceeds 4, an additional amount of 100,000 yen is to be added for each additional claim (according to the Rules of the Japan Intellectual Property Arbitration Center).

The designation of these technical standards is made pursuant to the provisions of Article 2 of the Procedural Rules for Essential Patent Evaluation. These are designated as "1. Subject Technical Standards relating to Digital Broadcasting ARIB Standards Patent Pool" in the Appendix 1 to the Procedural Rules for Essential Patent Evaluation, under the title "Technical Standards subject to Essential Patent Evaluation by the Center." Please refer to any applicable items contained in the "Center's Essential Patent Evaluation" on this homepage.

2. For an application for Essential Patent Evaluation, please take the following steps before the Japan Intellectual Property Arbitration Center (hereinafter, the "Center") in accordance with the provisions of Articles 3 and 14 of the Procedural Rules for Essential Patent Evaluation.

(1) For preparation of a written application, please use the predetermined format set by the Center, which can be downloaded from the Center's website. A written application form is to be submitted to the Center's Secretariat in electronic medium. In this connection, please refer to the item (3) below for further details.

(2) The Application form must be accompanied with the following items:
(a) Materials which are thought to be useful to support the applicant's contention on the grounds for essentiality and the list of such supporting materials,
(b) Copy of the Patent Gazette as published,
(c) Copy of the Patent Register,
(d) Copy of the Complete Set of File Wrapper,
(e) Certificate of Qualification of Representative, if the applicant is a juridical person,
(f) Document which shows the agent's representationship (power of attorney), if such an agent is appointed. and
(g) Letter of "Oath and Consent" in the form as designated in Appendix 2 by the Licensing Organization.

(3) Procedures for an application for essential patent evaluation are to be conducted electronically and, therefore, every document and material relating to the application is to be prepared and submitted in electronic form. As for the method by which the application is to be submitted electronically, please be sure to contact the Center's Secretariat, beforehand each time an application is to be submitted, for the information and explanation as to the method for submission of the application to a predetermined folder, which is to be set for your particular application and onto which the application is to be uploaded. What are required to be sent to the Center in electronic medium are one complete set of the written Application Form and its attachements of referential materials in PDF format and the written Application Form (without its attachments) in Word format.

For the "Grounds for Essential Patent Evaluation" in the Application for Essential Patent Evaluation form, please prepare your explanation on the comparison of the claims of the subject patent with the applicable Subject Standards in a table format as set forth in the Application Form. Please refer to a filled-in example of the Application Form attached hereto.

As for the List of Materials referred to in (2)(a) above, please identify each material with a number in sequence beginning with "1", such as "Material No.1, Material No.2, and indicate the title of material, the date produced/published, the name of author, and what is inteded to prove by each such material.

In case you quote, in your explanation/contention, any portion from the mateials under item (2)(a) above, namely the documents submitted to the JPO including application documents, documents received from the JPO, Gazettes, and relevant prior art documents, etc., please clearly point out such portion on the material by underlining or encircling in red line.

3. Application fees for the Essential Patent Evaluation for the ARIB Standard are set under agreement with the Digital Terrestrial Broadcasting Preparatory Committee as follows:

(1) In a case in which the number of claims submitted for evaluation is one (1) or two (2)---762,000 yen plus consumption tax
(2) In a case in which the number of claims submitted for evaluation is three (3) or four (4)---952,000 yen plus consumption tax
(3) In a case in where the number of claims submitted for evaluation exceeds four (4) ---an additional amount of 95,000 yen plus consumption tax is to be added per each additional claim.

4. The Applicant shall make applications for Essential Patent Evaluation in good faith only in respect of the patents that are considered in the Applicant's belief to be valid and essential.

5. The Applicant shall not raise any objections against any of the Evaluators in their representing any third party in a dispute against the Applicant in the future, except for a dispute involving the patents for which the Evaluators have handled the Essential Patent Evaluation on behalf of the Applicant.

(3) In a case where the number of claims submitted for evaluation exceeds 4, an additional amount of 100,000 yen is to be added for each additional claim (according to the Rules of the Japan Intellectual Property Arbitration Center).

2. For filing an application for essential patent evaluation with the Japan Intellectual Property Arbitration Center (hereinafter referred to as the "Center" ), the Applicant must take the following procedures in accordance with the provisions of Articles 3 and 14 of the Procedural Rules for Essential Patent Evaluation:

(1) For preparation of a written application, please use the predetermined format set by the Center, which can be downloaded from the Center's website. A written application form is to be submitted to the Center's Secretariat in electronic medium. In this connection, please refer to the item (3) below for further details.

(2) The following documents are to be attached to the Application Form:
(a) The referential materials considered to be useful to supports the reasons for essentiality of the patent in question and the list of referential materials,
(b) Copy of the Patent Gazette as published,
(c) Copy of the Patent Register,
(d) Copies of the complete set of the Patent Office file wrapper,
(e), In case the Applicant is a legal entity, a Certificate of Representative's Qualification,
(f) A Power of Attorney, in case the application is to be filed by an attorney entrusted with by the Applicant. and
(g) An "Oath and Consent" form, executed by the Applicant, of which form is designated by the License Organization concerned as Appendix 2 below.

    

(3) Procedures for an application for essential patent evaluation are to be conducted electronically and, therefore, every document and material relating to the application is to be prepared and submitted in electronic form. As for the method by which the application is to be submitted electronically, please be sure to contact the Center's Secretariat, beforehand each time an application is to be submitted, for the information and explanation as to the method for submission of the application to a predetermined folder, which is to be set for your particular application and onto which the application is to be uploaded. What are required to be sent to the Center in electronic medium are one complete set of the written Application Form and its attachments of referential materials in PDF format and the written Application Form (without its attachments) in Word format.

(Note 2) With regard to the item "Reasons for Essentiality" in the Application Form, the compatibility of the Claim elements with their corresponding portions of the Standards is to be made in a table format as set out in the Application Form. An English filled-in sample form is currently not available.

(Note 3) For the List of Referential Materials under item (a) above, those references are to be identified by corresponding numbers in sequence beginning with, for example, Reference No.1, with the Title of the Reference, the Date of Preparation/Issuance, the Names of the Composers, the Purpose of Use, etc.

(Note 4) When quoting, in the Application Form, certain portions of the references submitted, such as, for examples, the papers and notices filed with and received from the Patent Office in connection with the patent at issue, the Patent Gazette, the prior art references concerned, such portions quoted are to be clearly indicated on the references concerned by encircling the portions in red.

(Note 5) As for a Certificate of Representative's Qualification under item (e) above, submit a Certificate of Representative or a Certified Copy of the Commercial Register, issued within three months. Such a copy can be obtained at the competent local Legal Affairs Bureau having jurisdiction over the Applicant corporation concerned.

3. The Application Fees for Essential Patent Evaluation for the Digital Cable Broadcasting Standards are fixed under agreement with ULDAGE Inc. as follows:

(1) 762,000 yen plus consumption tax for a case in which the number of claims submitted for evaluation is one (1) or two (2) ;
(2) 952,000 yen plus consumption tax for a case in which the number of claims submitted for evaluation is three (3) or four (4) .
(3) In a case where the number of claims submitted for evaluation exceeds four (4), an additional amount of 95,000 yen plus consumption tax is to be added per each additional claim.

11. Confirmatory Evaluation on Essential Patent for the Digital Cable Broadcasting Standards

For applications for the Essential Patent Evaluation on the Digital Cable Broadcasting Standards, there is another type of evaluation system, which is different from the ordinary evaluation system mentioned in the foregoing. Namely, a Confirmatory Evaluation on Essential Patent can be applied for in respect of the patent for which essential patent evaluation has been granted for the Digital Broadcasting Standards (ARIB Standards) under the Center's evaluation proceedings and for which the ARIB Standards used for evaluation are limited to those which are included in the Digital Cable Broadcasting Standards (Appendix 1 to the Procedural Rules for Essential Patent Evaluation, "2. Standards for the Technology for Digital Cable Broadcasting")

To obtain a Written Essential Patent Evaluation, the applicant must submit to the Japan Intellectual Property Arbitration Center an Application for Essential Patent Evaluation and other documents required in accordance with the "Procedural Rules for Essential Patent Evaluation" mentioned above and pay the prescribed fees.

The designation of these technical standards is made pursuant to the provisions of Article 2 of the Procedural Rules for Essential Patent Evaluation. These are designated as "3. Subject Technical Standards relating to Ultra High-Definition Television Satellite Broadcasting Patent Pool" in the Appendix 1 to the Procedural Rules for Essential Patent Evaluation, under the title "Technical Standards subject to Essential Patent Evaluation by the Center." Please refer to any applicable items contained in the "Center's Essential Patent Evaluation" on this homepage.

2. For an application for Essential Patent Evaluation, please take the following steps before the Japan Intellectual Property Arbitration Center (hereinafter, the "Center") in accordance with the provisions of Articles 3 and 14 of the Procedural Rules for Essential Patent Evaluation.

(1) For preparation of a written application, please use the predetermined format set by the Center, which can be downloaded from the Center's website. A written application form is to be submitted to the Center's Secretariat in electronic medium. In this connection, please refer to the item (3) below for further details.

(2) The Application form must be accompanied with the following items:
(a) Materials which are thought to be useful to support the applicant's contention on the grounds for essentiality and the list of such supporting materials,
(b) Copy of the Patent Gazette as published,
(c) Copy of the Patent Register,
(d) Copy of the Complete Set of File Wrapper,
(e) Certificate of Qualification of Representative, if the applicant is a juridical person,
(f) Document which shows the agent's representationship (power of attorney), if such an agent is appointed. and
(g) Letter of "Oath and Consent" in the form as designated in Appendix 2 by the Licensing Organization.

(3) Procedures for an application for essential patent evaluation are to be conducted electronically and, therefore, every document and material relating to the application is to be prepared and submitted in electronic form. As for the method by which the application is to be submitted electronically, please be sure to contact the Center's Secretariat, beforehand each time an application is to be submitted, for the information and explanation as to the method for submission of the application to a predetermined folder, which is to be set for your particular application and onto which the application is to be uploaded. What are required to be sent to the Center in electronic medium are one complete set of the written Application Form and its attachements of referential materials in PDF format and the written Application Form (without its attachments) in Word format.

For the "Grounds for Essential Patent Evaluation" in the Application for Essential Patent Evaluation form, please prepare your explanation on the comparison of the claims of the subject patent with the applicable Subject Standards in a table format as set forth in the Application Form. Please refer to a filled-in example of the Application Form attached hereto.

As for the List of Materials referred to in (2)(a) above, please identify each material with a number in sequence beginning with "1", such as "Material No.1, Material No.2, and indicate the title of material, the date produced/published, the name of author, and what is inteded to prove by each such material.

In case you quote, in your explanation/contention, any portion from the mateials under item (2)(a) above, namely the documents submitted to the JPO including application documents, documents received from the JPO, Gazettes, and relevant prior art documents, etc., please clearly point out such portion on the material by underlining or encircling in red line.

In case the applicant is a juridical person, as for item (2)(e) above, please submit one original copy of the Certificate of Qualification of Representative or a certified copy of the Commercial Register issued by the competent local Legal Affairs Bureau having the jurisdiction over the company concerned (within three (3) months from the date of issuance).

3. Application fees for the Essential Patent Evaluation for the UHDTV Standards are set under agreement with ULDAGE Inc. as follows:

(1) In a case in which the number of claims submitted for evaluation is one (1) or two (2)---762,000 yen plus consumption tax
(2) In a case in which the number of claims submitted for evaluation is three (3) or four (4)---952,000 yen plus consumption tax
(3) In a case in where the number of claims submitted for evaluation exceeds four (4) ---an additional amount of 95,000 yen plus consumption tax is to be added per each additional claim.

OATH AND CONSENT ON ESSENTIAL PATENT EVALUATION

With regard to the filing of applications for Essential Patent Evaluation with the Japan Intellectual Property Arbitration Center (hereinafter referred to as the "Center"), we/I, the undersigned ______________________________________________________(name) (hereinafter referred to as the "Applicant") do hereby duly sworn, depose and say that:

1. The Applicant shall agree to comply with the Procedural Rules for Essential Patent Evaluation established by the Center.

2. The Applicant shall not use the results of the Essential Patent Evaluation received from the Center for any purposes other than joining any or all of the Patent Pools set out below:
・The ARIB Standards for Digital Broadcasting Patent Pool
・The Digital Cable Broadcasting Patent Pool
・The Ultra High- Definition Television Satellite Broadcasting Patent Pool
・The Ultra High-Definition Television Cable Broadcasting Patent Pool
・The Ultra High-Definition Television IPTV Broadcasting Patent Pool

3. The Applicant shall not use or otherwise disclose to others the contents, inclusive of the results, of the Essential Patent Evaluation received from the Center except for use in participating in the Pool.

4. The Applicant shall make applications for Essential Patent Evaluation in good faith only in respect of the patents that are considered in the Applicant's belief to be valid and essential.

5. The Applicant shall not raise any objections against any of the Evaluators in their representing any third party in a dispute against the Applicant in the future, except for a dispute involving the patents for which the Evaluators have handled the Essential Patent Evaluation on behalf of the Applicant.

IN WITNESS WHEREOF, the Applicant hereby execute this document and submit the same to the Center together with the necessary documents as specified in Article 3 of the Procedural Rules for Essential Patent Evaluation.
