Confirmatory evaluation of essential patents for the digital cable broadcasting standards (reevaluation based on the previous evaluation result that the patent in question is essential for the applicable standard)

For calls for patents essential to the digital cable broadcasting standards, an application for confirmatory evaluation may be submitted, aside from the original standard essential patent evaluation. For a patent determined by JIPAC as essential for only the digital broadcasting standards included in "Appendix 1-2. Technical Standards for 'Digital Cable Broadcasting Pool'" of Procedural Rules for Essential Patent Evaluation, an application may be submitted to JIPAC for confirmation of the said effect (this is called "confirmatory evaluation").

1. For a patent previously determined by JIPAC as essential for the digital broadcasting standards (ARIB standards), to apply for confirmatory evaluation of the patent for only the ARIB standards included in "Appendix 1-2. Technical Standards for 'Digital Cable Broadcasting Pool'" of Procedural Rules for Essential Patent Evaluation, the applicant must submit an Application Form for Confirmation of Standard Essential Patent Evaluation by JIPAC in the designated format and other designated documents and pay the designated application fee for confirmation of standard essential patent evaluation (48,000 yen plus tax per application) to JIPAC.

Submit the designated Application Form for Confirmation of Standard Essential Patent Evaluation to the JIPAC secretariat. Download the example format of application form and fill in all required items for submission.

2. For a patent previously determined by JIPAC as essential for the digital broadcasting standards (applicable ultrahigh definition television (UHDTV) satellite broadcasting standards), to apply for confirmatory evaluation of the patent for only STD-B24, STD-B25, and STD-B32 included in "Appendix 1-2. Technical Standards for 'Digital Cable Broadcasting Pool'" of Procedural Rules for Essential Patent Evaluation, the applicant must submit an Application Form for Confirmation of Standard Essential Patent Evaluation by JIPAC in the designated format and other designated documents and pay the designated application fee for confirmation of standard essential patent evaluation (48,000 yen plus tax per application) to JIPAC.

Since the whole procedure is electronic, the applicant is to prepare all required documents including the application form in electronic format and submit them electronically. For how to submit such data, be sure to contact the JIPAC secretariat beforehand as such application documents must be uploaded to a specific folder to be set for each application. The applicant will be notified of the specific folders set for the application. All subsequent communication related to the application between the applicant and the evaluators/JIPAC, including delivery of the written evaluation result, will be made via this specific folder.
