Center's Advisory Opinion on Essentiality

What is Advisory Opinion on Essentiality?

An Advisory Opinion on Essentiality means the issuance of advisory opinions by the Center on whether or not a particular patent is essential for implementation of functions and effects as prescribed in a particular technical standard (hereinafter, the "Subject Technical Standard"), based on the agreement between the Center and the licensing organization of essential patents relating to the Subject Technical Standard (hereinafter, the "Licensing Organization").

Procedures for Advisory Opinion on Essentiality are provided in the "Procedural Rules for Advisory Opinion on Essentiality."As for the flow of procedure, please refer to the "Procedural Flow of Advisory Opinion on Essentiality."

Please prepare a written application for Advisory Opinion on Essentiality in accordance with the format of "Written Application for Advisory Opinion on Essentiality"provided by the Center, and submit it.

Each Licensing Organization provides fees for Advisory Opinion on Essentiality in a written agreement with the Center.

2. 日本知的財産仲裁センターは、このARIB標準規格に必須であると思われる特許について、日本知的財産仲裁センターが定める「必須判定手続規則」に則って、必須特許であるか否かにつき判定(必須特許評価)を行います。

この必須判定を受けるためには、前記の「必須判定手続規則」に従って、日本知的財産仲裁センターに対して、所定の書式による必須判定申立書及びその他所定の書類を提出し、且つ所定の必須判定申立手数料を支払わなければなりません。

ライセンス受託事業を行うアルダージ株式会社は、本日2006年8月8日より日本のデジタル放送規格(社団法人電波産業会策定:以下ARIB標準規格)必須特許の募集を行います。デジタル放送の市場を広げるために、中立的な専門家が必須特許の評価を行い、複数の特許権者が所有する特許を一括で、公平にかつ合理的な条件でライセンスすることを目的としています。
特許募集および特許評価手続の概要は以下の通りです。

申立特許1件につき、申立対象の特許請求項が2項までは80万円、4項までは100万円、4項を超える場合は1項増す毎に10万円を加算します(日本知的財産仲裁センターの規則による)。

With regard to the application procedure for Advisory Opinion on Essentiality in connection with the digital broadcasting standards (ARIB Standards)

1. The technical standards which are subject to this offer for application of essential patents shall be limited to the following designated standards of the ARIB Standards.

Provided, MPEG-2 Standard, MPEG-4 Standard, H.264|MPEG4AVC Standard, IEEE1394 Standard, and the portion of Server-type Broadcasting shall be excluded from the scope of the pool.

The designation of these technical standards is conducted pursuant to the provision of Article 2 of Procedural Rules for Advisory Opinion on Essentiality. These are designated as "1. Subject Technical Standards relating to Digital Broadcasting ARIB Standards Patent Pool" in the Appendix 1 of Procedural Rules for Advisory Opinion on Essentiality "Technical Standards subject to Advisory Opinion on Essentiality by the Center." Please refer to the necessary matters in the "Center's Advisory Opinion on Essentiality" of this homepage.

2. In order to make an application for Advisory Opinion on Essentiality, the following each procedure shall be undertaken in accordance with the provisions of Articles 3 and 14 of Procedural Rules for Advisory Opinion on Essentiality to the Japan Intellectual Property Arbitration Center (hereinafter, the "Center").

(1) Please submit a written application for Center's Advisory Opinion on Essentiality (one original copy and two duplicates) to the Center's secretariat. For the preparation of this written application, please download a model format (a word file) from the Center's homepage and fill it out.

(2) Please attach the following items to this written application
(a) Written application for Center's Advisory Opinion on Essentiality two duplicates
(b) Materials which the applicant believes to prove the grounds for the application, and the list thereof one original copy, two duplicates
(c) Copy of Register of Patents one original copy, two duplicates
(d) Complete Set of File Wrapper one original copy, two duplicates
(e) Certificate of qualification of the representative, if the applicant is a juridical person. one original copy
(f) Document which proves the representative capacity (power of attorney), if agents are appointed. one original copy
(g) Letter of oath and agreement in the format of Appendix 2 designated by the licensing organization, in cases where the licensing organization demands it. one original copy

    

(Note 1)
For descriptions in the "grounds for the application" in the written application for Advisory Opinion on Essentiality as provided for in (a) above, please prepare the explanation of comparison between the claims of the subject patent and the subject standard in table form, after the example of a written application for Advisory Opinion on Essentiality (Sample) attached hereto.

(Note 2)
Please include the material number, material name, date produced, author, and those matters which the material is intended to prove, etc. in the list as provided for in (b) above. Please represent the materials numerically, such as, "Material 1," and "Material 2."

(Note 3)
In the case where you refer to documents submitted to the JPO including application documents, documents received from the JPO, gazettes, and relevant prior art documents, etc. for the explanation as materials as provided for in (b) above, please clearly represent the referred parts by marking them in red, etc.

(Note 4)
In the case where the applicant is a juridical person, please submit one original copy of a certificate of qualification of the representative or a certified copy of commercial registration, etc. (within three (3) months from the date of issuance) as the "certificate of qualification of the representative" as provided for in (e) above. These are available at the Legal Affairs Bureau which exercises jurisdiction over the relevant company according to its address.

(3) Please electronically transmit the written application which the applicant prepared in accordance with (1) above as an e-mail attachment to the e-mail address info@ip-adr.gr.jp which the Center has designated.
In addition, please print out the prepared written application in word file format (a signature and seal of the applicant or its agent are required), and send one original copy and two duplicates thereof to the Center by certified e-mail. Each original copy and duplicate shall be accompanied by the relevant documents which have not been able to be sent by e-mail.

3. Application fees for Advisory Opinion on Essentiality in connection with the ARIB Standard are provided as follows by the agreement with the digital terrestrial broadcasting preparatory committee.

(1) The number of claims of the subject patent to the application is equal to or less than two---800,000 yen
(2) The number of claims of the subject patent to the application is equal to or less than four---1,000,000 yen
(3) In the case where the number of claims of the subject patent to the application is more than four, for each additional claim (from fifth claim)---100,000 yen shall be assessed.

4. When an application for Advisory Opinion on Essentiality is made, one pair of panelists consisting of one attorney-at-law and one patent attorney, who are neutral and impartial and have no interest in the relevant application case, shall be appointed and the proceedings to issue an advisory opinion on essentiality shall be conducted. The Center aims to have all written Advisory Opinion on Essentiality drafted within two (2) months from the receipt of application.

1. Format of Letter of Oath and Agreement designated by the digital terrestrial broadcasting preparatory committee in connection with the ARIB Standard patent pool relating to digital broadcasting

Letter of Oath and Agreement
by Applicant for Advisory Opinion on Essentiality

The applicant for the Advisory Opinion on Essentiality (hereinafter, the "Applicant") hereby makes an oath and agrees to the following items, upon its submission of a written application to Japan Intellectual Property Arbitration Center (hereinafter, the "Center").

(1) Applicant shall agree to Procedural Rules for Advisory Opinion on Essentiality.

(2) Applicant shall use the conclusion of Advisory Opinion on Essentiality described in the written Advisory Opinion which Applicant has received from the Center only for the purpose of establishment of ARIB standard patent pool (hereinafter, the "Pool") relating to the digital broadcasting.

(3) Applicant shall not disclose or use the written Advisory Opinion which Applicant has received from the Center and the conclusion of Advisory Opinion on Essentiality described therein, for any purposes other than participating in the Pool.

(4) Applicant shall make an application with regard to only such patents that Applicant believes valid and essential, and shall make an application for Advisory Opinion on Essentiality in good faith.

(5) Applicant shall agree that a panelist may act as an agent of a third party opposing Applicant, in the future, except disputes relating to patents owned by Applicant on which such panelist has conducted the Advisory Opinion on Essentiality.

IN WITNESS WHEREOF, Applicant shall execute this Letter of Oath and Agreement by the applicant for this Advisory Opinion on essential patent for one copy, and shall submit it to the Center with the documents as provided in Article 3 of Procedural Rules for Advisory Opinion on Essentiality upon making an application for an Advisory Opinion on Essentiality.
